Introduction & Acceptance of Terms

These policies operate as binding terms and conditions when purchasing any service from Rightway Studio, including but not limited to web development, application development, branding and design, hosting, cloud infrastructure, and ongoing system management.

By accepting a quote, making payment, or using any service provided by Rightway Studio, the client confirms that they have read, understood, and agreed to these terms in full. All services are explained prior to purchase, and it is the responsibility of the client to request clarification on any aspect of the service before payment is made. Expectations that were not discussed or agreed upon in writing prior to purchase do not form part of the service obligation.

Definitions

“Rightway Studio” refers to Rightway Studio, its owner, representatives, employees, and contractors.
“The Client” refers to the individual, company, or organisation purchasing services.
“The Work” refers to any service or product produced for the client within an agreed scope, including but not limited to websites, applications, hosting environments, designs, branding assets, documentation, and system configurations.
“Scope of Work” refers to the services outlined in an accepted quote, proposal, or written agreement.

Scope of Work & Project Execution

All services are delivered strictly according to the agreed scope of work as outlined in the accepted quote, proposal, or written agreement. The scope defines what will be delivered, how it will be delivered, and the boundaries of the project.

Any request that extends beyond the original scope, including additional features, pages, integrations, revisions, design changes, or changes in direction,  is considered additional work. In such cases, Rightway Studio reserves the right to pause the project, revise timelines, and issue a new or updated quote. Work will only proceed once scope changes have been approved in writing.

Design & Creative Services Policy

Design services provided by Rightway Studio include logos, brand systems, business profiles, documents, marketing assets, websites, applications, and social media materials. Design direction is based on information gathered during the onboarding process and any reference material supplied by the client.

Revisions are limited to what is included in the agreed scope of work. Once final designs are approved, they are considered accepted. Subjective dissatisfaction that falls outside the agreed objectives does not constitute incomplete work. While personal taste may vary, Rightway Studio guarantees professional execution aligned with industry standards and the objectives defined at project commencement.

Project Timelines & Delivery

Project timelines are provided as estimates and are dependent on timely client feedback, content delivery, approvals, and payment schedules. Delays caused by incomplete client input, late responses, or changes to scope will automatically extend delivery timelines.

Rightway Studio is not responsible for missed deadlines resulting from delays outside of its control. A project is considered complete once the agreed scope has been delivered and the client has either confirmed acceptance or failed to respond within seven days of delivery.

Quotes, Estimates & Payments

Quotes issued by Rightway Studio are valid for the period stated and reflect the scope and requirements discussed at the time of quotation. Estimates are provided in good faith and may change if project requirements evolve.

A deposit is typically required before work begins. The remaining balance is payable within seven days of project completion unless otherwise agreed in writing. If payment is not received within this period, Rightway Studio reserves the right to withhold access to the work, suspend services, or pursue recovery through legal means if the work is being used without full payment.

Invoicing & Late Payments

Invoices are issued for both once-off and recurring services and clearly outline the services provided and fees charged. Payment terms are specified on each invoice.

Late payments may incur a late payment fee as stipulated on the invoice or quote. If an account remains unpaid beyond the due date, Rightway Studio reserves the right to suspend or terminate services until the outstanding balance is settled in full.

Hosting & Server Hosting (RightwayHost)

When hosting services are provided through Rightway Studio or RightwayHost, websites and systems are hosted on managed cloud infrastructure selected and maintained by Rightway Studio. These environments are designed for performance, security, and stability and are not shared or oversold in a manner that compromises reliability.

Hosting fees and domain renewal costs are the responsibility of the client. Failure to settle hosting fees may result in service suspension or termination. Rightway Studio is not responsible for data loss resulting from account suspension or termination due to non-payment.

Web & Server Management Services

Management services include ongoing monitoring, updates, security maintenance, backups, and performance optimisation as defined in the selected management plan. These services are intended to maintain system stability and reliability rather than introduce new features or functionality.

Any development, feature additions, or major changes requested outside of management scope may be quoted separately. Rightway Studio cannot be held responsible for systems that it does not host or manage directly.

Ownership, Access & Transfers

Once all outstanding fees have been settled, clients may request access to their website files or a download of their system. Domain transfers will be approved provided all associated fees have been paid. Any third-party transfer or reinitialisation fees are the responsibility of the client.

If services are cancelled or suspended, reactivation, re-upload, or migration fees may apply. Rightway Studio reserves the right to withhold files, access, or transfers until all outstanding balances are cleared.

Support & Business Hours

Standard business hours are Monday to Friday, from 09:00 to 17:00. During these hours, support requests may be submitted via email, phone, or messaging platforms listed on the Rightway Studio website.

Non-urgent requests outside business hours should be submitted via email. Requests made outside business hours through other channels may be billed as after-hours support. Urgency is assessed at the discretion of Rightway Studio.

Payment Methods & Recurring Billing

Clients are required to make use of the approved payment methods provided by Rightway Studio, including automated recurring billing for monthly services. Failure to comply with billing requirements may result in service suspension or termination.

Rightway Studio reserves the right to refuse alternative payment arrangements unless agreed upon in writing.

Cancellations & Notice Periods

Clients wishing to cancel services must provide at least one calendar month’s written notice. Failure to provide sufficient notice may result in a cancellation fee. Outstanding balances must be settled before any services, files, or domains are transferred or released.

Client Content & Legal Responsibility

Rightway Studio is not responsible for the legality, accuracy, or compliance of content supplied by clients. All responsibility for claims, representations, and legal compliance remains with the client unless explicitly stated otherwise in writing.

Legal Compliance & Enforcement

Rightway Studio operates in accordance with the laws of South Africa. If unlawful or questionable activity is identified, services may be suspended immediately, and Rightway Studio will cooperate fully with lawful investigations.

Rightway Studio reserves the right to pursue legal action should contractual obligations not be met.

Policy Updates

These policies may be updated periodically. Continued use of services constitutes acceptance of any updated terms.
